ATLAS RESIN LTD 

Terms and Conditions of Service 

These Terms and Conditions apply to all quotations, contracts and services provided by Atlas Resin Ltd. 

 

1. Definitions 

“Company” refers to Atlas Resin Ltd. 
“Client” refers to the individual or business purchasing services. 
“Works” refers to all resin flooring installation services provided by the Company. 
“Site” refers to the property where works are carried out. 

 

2. Quotations 

All quotations are valid for 30 days unless otherwise stated. 

Quotations are based on information provided by the Client and are subject to site inspection. The Company reserves the right to amend pricing if site conditions differ materially from those described prior to quotation. 

 

3. Deposit Structure 

A 50% non-refundable deposit is required to secure materials and confirm scheduling of works. 

The deposit covers the cost of materials and protects the Company against financial risk associated with ordering specialist resin products. 

Works will not be scheduled or materials ordered until the deposit has cleared into the Company’s bank account. 

 

4. Payment Terms 

The remaining 50% balance is due immediately upon completion of the Works. 

Final payment must be made within 24 hours of project completion unless otherwise agreed in writing. 

Payments must be made via bank transfer unless an alternative payment method has been agreed in advance. 

Failure to make payment within the agreed timeframe may result in additional recovery costs and statutory interest being applied in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. 

 

5. Cancellation Policy 

If the Client cancels after paying the deposit but before materials have been ordered, the Company may retain an administrative fee. 

If the Client cancels after materials have been ordered, the deposit is non-refundable. 

If the Client cancels once works have commenced, the Client remains liable for: 

  • All materials ordered 

  • Labour costs incurred 

  • Any additional losses reasonably suffered by the Company 

If the Company is required to suspend works due to Client instruction or access issues, additional charges may apply. 

 

6. Access and Site Conditions 

The Client must ensure: 

  • Clear and safe access to the Site 

  • Adequate power supply 

  • Removal of furniture and belongings prior to commencement 

  • Suitable working conditions 

Delays caused by lack of access or preparation may result in additional charges. 

 

7. Surface Condition Disclaimer 

All resin flooring installations depend on the condition of the existing substrate. 

The Company is not responsible for: 

  • Pre-existing structural defects 

  • Hidden cracks or movement within the substrate 

  • Moisture levels exceeding acceptable limits 

  • Subfloor failure not visible at initial inspection 

Moisture testing may delay installation if readings exceed manufacturer recommendations. 

Crack repairs, levelling compounds or additional preparation identified during works may incur additional costs, which will be agreed with the Client before proceeding where reasonably possible. 

 

8. Material Delays Clause 

The Company is not liable for delays caused by: 

  • Supplier stock shortages 

  • Delivery disruptions 

  • Manufacturer delays 

  • Circumstances outside reasonable control 

Where material delays occur, the Company will inform the Client promptly and reschedule installation at the earliest available opportunity. 

 

9. Installation Variations 

Resin flooring is a hand-finished system. Minor variations in shade, pattern and finish are inherent characteristics of decorative resin systems and do not constitute defects. 

Metallic and marble-effect floors are artistic finishes and exact replication of sample images cannot be guaranteed. 

 

10. Warranty and Limitations 

The Company provides a 12-month workmanship warranty from the date of completion. 

This warranty covers installation defects directly caused by the Company’s workmanship. 

The warranty does not cover: 

  • Damage caused by misuse, heavy impact or chemical abuse 

  • Structural movement of the building 

  • Moisture ingress after installation 

  • Normal wear and tear 

  • Damage caused by third parties 

Liability is limited to the value of the contract price. 

 

11. Limitation of Liability 

The Company shall not be liable for indirect or consequential losses, including loss of business or profits. 

Total liability shall not exceed the contract value of the Works. 

 

12. Force Majeure 

The Company shall not be held liable for failure or delay in performance due to events beyond reasonable control, including but not limited to extreme weather, supply chain disruption, strikes, or government restrictions. 

 

13. Governing Law 

These Terms and Conditions are governed by the laws of England and Wales. 

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. 

 

This document reflects standard practices within the UK flooring and construction industry and protects both Atlas Resin Ltd and its Clients.
